Privacy Policy

1.1 This Privacy Policy governs the use and processing of personal information collected through the official website ("Website" or "Orange Cat Design"), accessible at www.orangecatdesign.com, by any person who accesses it, whether for commercial or non-commercial purposes ("User" or "Client").

1.2 The responsible for the processing and use of the information referred to in the preceding paragraph is Marina Varisco Novaes, in their capacity as Website manager ("Service Provider").

1.3 In accordance with the applicable legislation on the protection of personal data and with regard to the services provided, namely in relation to any information and/or electronic communications, the User, by providing any data, expressly accepts and acknowledges that the personal data provided at the time of registration as a User, as well as those provided for the purpose of making online purchases, shall be incorporated into a Client database owned by the Service Provider.

1.4 The Client further consents to the use and processing of their personal data for the purposes of providing the services and products acquired, as well as for receiving information, via email, telephone contact or any other means, regarding news, products and services related to Orange Cat Design, provided that such consent is optional and may be withdrawn at any time without prejudice to the User, namely by selecting the "Unsubscribe" option.

1.5 The Client further acknowledges that the personal data collected by the Service Provider are adequate, relevant, necessary and limited to the scope of Orange Cat Design and to the fulfilment of the services or products acquired by the Clients.

1.6 The Service Provider expressly acknowledges and ensures that it shall maintain a documented record of all activities involving the processing of personal data provided by the Clients.

2.1 The Service Provider shall not be responsible for any use of personal data relating to third parties other than the Client. It is the sole responsibility of the latter to obtain the consent of the data subjects of any third-party data provided. The User further guarantees that the personal data supplied are true, accurate, up to date and correct, undertaking to notify the Website of any changes and/or rectifications thereto.

2.2 Any loss, misplacement, damage or other prejudice caused to the services provided or products acquired as a result of incorrect or inaccurate data shall be the sole responsibility of the User.

3.1 The Service Provider ensures the confidential nature of all personal data collected and provided by the Client, as well as their integrity and confidential processing, allowing access thereto solely to those whose access is strictly necessary for the provision of the products or services acquired by the Client, and undertakes, for such purposes, to implement the appropriate technical, organisational and security measures necessary to prevent unauthorised, improper or abusive alteration, loss, processing or access, in accordance with Lei 58/2019 de 8 de Agosto, as amended, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), and all other applicable legislation.

3.2 The User is hereby informed that the personal data collected for processing purposes may be disclosed to any entity where such disclosure is required to comply with legal obligations or is requested by public authorities with the appropriate powers, such as Autoridade Tributária e Aduaneira or the Courts.

4.1 Without prejudice to any other rights granted by law to personal data subjects under the terms set out above, the User may, at any time, exercise their rights of access, rectification and deletion of their personal data, submitting, for this purpose, a written request to Orange Cat Design.

4.2 The exercise of the right to cancel or withdraw consent shall not invalidate the processing already carried out under previously given consent, nor shall it affect the processing of data required as a result of the Provider's compliance with legal obligations.

4.3 All personal data collected shall be retained for as long as the provision of services or supply of products subsists, without prejudice to mandatory data retention periods arising from legal obligations, namely in labour, tax or anti-fraud matters. The Client also has the right to data portability, that is, to receive or transfer to another entity the personal data provided to the Website, in a structured, commonly used and machine-readable format.

5.1 The Provider undertakes, in relation to its Clients, as a source of personal data, to scrupulously observe the following rules:

5.2 In any case, should unlawful or abusive use of the data provided to Orange Cat Design be verified, the data subject may lodge a complaint with the Comissão Nacional de Proteção de Dados (CNPD), the competent authority for the analysis and assessment of such complaints.

6.1 The Website uses online advertising tools, namely those provided by Meta Platforms Ireland Limited, for the purpose of displaying personalised advertising and assessing the effectiveness of advertising campaigns.

6.2 The User's browsing data may be used for this purpose, such as cookies and information regarding the device and the use of the Website. For this purpose, the User must provide their consent through the cookie acceptance mechanism made available on the Website, which may be withdrawn at any time under the applicable terms.

6.3 The data collected may be transmitted to Meta Platforms, which may entail their transfer to third countries, in accordance with the applicable legal terms.

7.1 The Service Provider reserves the right to unilaterally amend its privacy practices and policies, subject to prior notice given at least 14 days in advance, and shall permanently make the current version available on the official Website, which shall take effect immediately upon publication.
